Hit by an Uninsured Motorist

My question involves an injury that occurred in the state of: Texas

How can I pursue getting my $500 deductible back from the uninsured motorist who hit me? Do I have any legal recourse? He stated to the officer at the scene of accident he had insurance and was cited for not having proof. I am unsure if his ticket was paid. He failed to respond to my insurance companies certified letters, but I have his adress.

If your ins. co. is unable to get it back, you probably will have to sue in small claims court.
