    Default Unemployment Denial Due to Being Detained

    My question involves unemployment benefits for the state of: Florida

    Greetings,

    I was receiving benefits up until a 2 months ago.A rep from unemployment called me and said that my employer said I quit.I voluntarily gave them too much information in my response by saying that I was detained for six months after returning from vacation by immigration.Of course they denied me due to incarceration(different from being detained,right?).My employer has no knowledge of me being detained,unless they know now because of my hearing.

    I am currently due for an appeals hearing in TOMORROW(representing myself...-PLEASE HELP).My questions are as follows:

    1) Can I say I made a mistake and was detained for a lesser time?
    2) Can I retract my statement that I made about being detained?If so, how do I go about it?
    3) What are the chances of me winning?
    4) May I please have a few tips on how to win?

    1.) DID you make a mistake about the length of time you were detained?
    2.) See #1
    3.) We have no way to calculate the odds
    4.) Not until you answer #1 - it makes a difference to the answer.

    Yes,I suppose so.Do es unemployment have the ability to check my detention records?(I guess this would make question #5...sorry)

    I don't see any reason why they couldn't, though I don't know if they would. However, you appear to be evading the question.

    I want to make it absolutely clear. DO NOT LIE. If you honestly made a mistake, you can correct it, but if you are now looking to backtrack because you think they'll like a new answer better than the first one, that is a very, very bad idea. UI offices can and do run random audits to confirm information (they did one on me once) and you do not want them to catch you in an untruth. If you're going to change your story tomorrow, EVEN IF YOU ARE CORRECTING AN ERROR, be VERY certain that you can back up what you are saying or you will make matters worse for yourself. They are not going to look kindly on someone changing their story in any case.

    No, I can't give you any tips on how to win, because I have no idea what information your employer is going to present or how the ALJ will see it. I've already given you the best information anyone can: Tell The Truth.

    If you go through the appeal, you might win and you might not.

    If you don't go through the appeal, you definitely won't win.
