    Question Can I Cancel My Loan Due to Car Problems

    My question involves a consumer law issue in the State of: Massachusetts

    I purchased my vehicle in May of 2008. Since that time the dealership has had the car longer than I have! I keep bringing it back due to one problem or another. It started a month after buying the car the service engine light came on. From that point on this car has been in their shop once a week every single month that I have owned it (unfortunately, I am not exaggerating the amount of time they have had the car).

    They have replaced everything INCLUDING the engine. I did purchase the extended warranty and they are covering everything. I do believe they are doing everything possible but enough is enough! I cannot afford rental cars every month. I bought a car so I could have a car! I am extremely frustrated over this whole situation and want to know if it is possible to get out of this loan. The vehicle is a 2007 Nissan and I bought the car for $11K and owe about $8K

    Yes, from a Dealership in my area but what difference would that make? If they sell a car, new or used, I would expect to work without problems immediately after I bought it. If I bought from a private dealer, then I could see this being a different issue.

    The difference is whether your car falls under a new car "lemon law" or whatever protections your state offers in relation to used car sales. The good news for you is that Massachusetts offers comparatively strong protections to used car buyers.

    Among the remedies for covered vehicles,
    Quote Quoting Dealer Refunds
    The limited used vehicle warranty provided by the dealer gives you the right to a refund if the vehicle was either:
    • repaired 3 times for the same use or safety defect that continued to exist or recurred during the warranty period,

    OR

    • out of service by reason of repair or invalid refusal to repair for at least 11 business days during the warranty period, not necessarily all at one time.
    NOTE: Business day is defined as Monday through Friday, except for state or federal holidays. When counting the number of business days your car has been out of service, any part of a business day counts as a whole day.
