    Default Removing an Asset from a California Living Trust

    I have a Ca. revocable living trust that has a property (real estate), that I want to gift to my Son. Do I need to remove it from the Trust? If so, how can I remove that asset from the Trust. Thank you.

    If you transferred it into the trust, in order to convey it to your son you must transfer it back out of the trust. As it's a revocable trust, assuming you're the trustee (as you normally would be) you do that by deed - the same way you put the real estate into the trust. You may want to have the lawyer who helped you do that prepare the deed, so that you can be assured that it's in proper form.
