    Default Improper Backing with No Accident

    My question involves a traffic ticket from the state of: Georgia

    Hello - I was given a ticket for improper backing. I was in the turning lane which had 1 lane on either side. I missed my turn so I backed up approximately the length of my car and turned into a library. There were no other cars around and it did not cause any kind of accident. A police friend of mine said he had never heard of giving that kind of ticket when an accident was not involved. The code on the ticket is 40-6-240, and the wording saying "limitations on backing".

    Thanks for any help you could offer.

    Quote Quoting Georgia Code Sec. 40-6-240.
    (a) A driver shall not back a vehicle unless such movement can be made with safety and without interfering with other traffic.

    (b) A driver of a vehicle shall not back a vehicle upon any shoulder or roadway of any controlled-access highway.
    I guess you can try to convince the court that you were able to back safely, without interfering with other traffic.
