    As aaron stated, what is your "legal" situation, exactly?

    Criminal filings, be they misdemeanor or felony, depend on state and/or federal statute. If the charges warrant a felony charge, then it is what it is and that's how the charges will be filed. Remember that federal law trumps state law.

    Also BOTH the feds and the state can charge you with the same offense under the respective laws, it does not trigger double jeopardy.
