    Default Policy Changes

    My question involves labor and employment law for the state of: Kentucky

    I filed paperwork for my company's Tuition Reimbursement program and was approved on September 17, 2007. In January of 2008 the company issued a policy change stating that those entering the program prior to September 15, 2007 would now have to follow different guidelines.

    Is it legal for them to change the policy that I agreed to? Is there no binding in the agreement that we both signed in 2007?

    If you were approved on September 17, 2007, that is NOT prior to September 15, 2007.

    And why did you wait till April, 2009, to address the question.

    It didn't dawn on me until they tried to change the policy for a second time (this month) that I might have any recourse to what they were telling me.

    I realize that I should have raised this question with them last year, but at that time I assumed that since they said they could do this, they could. Now I am wondering if that is the case.

    Am I too late in asking?

    and sorry, i got my dates backwards. I was approved on September 17 and the new policy state anyone approved AFTER September 15, which would include me.

    Again, my apologies on the mistake.

    Unfortunately, I can't read the agreement from here, and that is what it would take to see if you ever had any recourse. I don't know offhand what the statute of limitations on this would be, if you do.

    My advice would be to take the agreement and all subsequent documentation to an attorney in your state for review. An employer DOES have the legal right to make changes to the policy, but I am not in a position to say if the agreement you had signed two days previously is enforceable.
