Evicting a Non-Rent Payer, Not on Lease in Ohio

My question involves an eviction in the state of: Ohio

My roommate's boyfriend lives at our apartment. He pays no rent, no utilities. He never signed a lease and our lease states guest should not stay for over three nights. He is out of control, they fight, he hits things, but my roommate does not make him leave because he claims he has no where else to go. Can I evict him since he isn't on the lease and has never paid a bill?

Yes you can, but legally he is considered tenant-paying or not. You need to follow the eviction process in your state.

Except he will probably argue that he's not a tenant - he's your roommate's house guest, and that she (as a joint tenant) is free to invite him over as she pleases.

You can go to your own landlord in relation ot the "three nights" rule, but be aware that the landlord could only take action against your tenancy (not directly at the boyfriend). Also, if the lease imposes a penalty for having an unauthorized tenant, you may be liable (jointly with your roommate) to pay that penalty.
