Default Paternity Establishment and Grandparents Rights
My question involves paternity law for the State of: Arkansas

My sibling recently passed away and left behind a baby girl. She was unwed. The "father" currently has the baby. The baby shares the father's name. However, we are not sure if he ever signed the birth certificate. If he did not, what legal action can the grandparents of baby girl take?

If he's established as the legal father, and they think they have a case to do so, they can petition for guardianship. If he's not established as the legal father, they can do the same thing and ask the court to order DNA testing.

Not liking dad, or not wanting him to raise the child, won't be sufficient to get guardianship. Petitioning for guardianship and losing is often a good way to convince the other parent to deny access to the child. This is best done in consultation with a lawyer.
