    Unhappy Car Hit by a Drunk Driver

    California

    So about 3 weeks ago, my car was struck by a drunk driver while parked on the street.the driver tried to get away but was detained a block away. My car was declared a total loss and now I have nothing to drive. The screwed up part is that I bought this car from a dealer last September and since then have been in a dillema since they didn't have the title when they sold it to me. My insurance company can't send me the check and the dealer is in a lawsuit with the bank they originally bought it from. I feel I was wronged by the dealer and now screwed over by the person who totalled my car. What can I do? I work 2 jobs and go to school. I need help.

    Well from my memory, California requires the title transfer with the sale of the vehicle. I would be contacting a lawyer and filing for a fraudlent auto sale against the dealer.

    By law the dealership can not sell the vehicle with out title. So the dealer should have not sold the car at all until they had posession of the title for the vehicle.

    Just to make this clear, this goes with any sale of an automobile whether it is by dealer or private party.

    Now to make matters worse your stuck with a vehicle that is wrecked the insurance company can not do anything for you. Why because there is no title to show proof of ownership.

    The only other option you would have is to sue the driver of the vehicle for the amount of the vehicles worth.

    To find the vehicles worth you can use nada or kelly blue book.

    The other option is to wait till the dealership can provide you with the title.

    so i spoke with a lawyer and he says the only thing i can do is take the dealer to small claims. and if i do so, the legal fees and all would pretty much even out with my amount put down.

    ive been trying to find out information of the driver who hit my vehicle but my insurance hasnt been helpful at all. my insurance wants to give me just about $7k when the dealer just paid a little over $9k 2 weeks prior to the accident. so now i cant get my down payment back from anyone and am still carless a month after the incident. ive had to drop out of school since i have no transportation and its hard enough to get to work now.
