Default Federal Charges for Obtaining a Social Security Number Under a False Name
Good Morning, I could use a little help with a matter that has been brought against my wife. She is a Canadian Citizen and back in 1988 she was married to a US Service Gentleman and came into the country via Thousand Island, NY and then was moved with her then husband to Ft. Drum, New York, a military base. At that time it was my understanding from what she explained she applied for a Social Security Number, she had to provide her Birth Record and Marriage Certificate and the JAG Office was supposed to have handled the paerwork, she was issued a Social Security Number and Card. This past Monday she was served with a Federal Indicment that states that she falsely obtained a Social Security Number, something on the lines of using a false name or an incorrect name and has her initial charges to be issued on Tuesday at a federal courthouse here in PA. On this paperwork they show her original birth name from Canada and then she was adopted and married the gentleman, they are saying her name is incorrect and thus, is illegal.

How serious is something like this to deal with ?

Back then, would Social Security still have some type of an archived record of that initial application ?

Any suggestions to how to approach this matter ?

We are in a tight financial situation and they stated they will have a Federal Defender on standby for her to use.

Any assistance or insight would rweally be a blessing right now. She has never been in any type of trouble, only a parking ticket here and there and never had issues with jobs or anything, she pretty much is a normal everyday person.

Federal charges are very serious. She should be consulting a criminal defense lawyer. Is this a charge under 42 USC § 408? If so, which subsection? If not, what statute and subsection?

She and her lawyer can figure out what records Social Security has.
