    Default Debt Collectors and Power of Attorney

    My question involves collection proceedings in the State of: CA

    What can I do if a debt collector rejects a power of attorney that I have given to a 3rd party debt settlement company? Are there any steps or remedies I can pursue?

    Also, out of curiosity, does an attorney that you hire require a power of attorney from you? Or just the fact that he represents you gives him the power to act on your behalf?

    Collectors are not required to work with these companies. If the collector refuses to work with the company, you're on your own.
    Also, out of curiosity, does an attorney that you hire require a power of attorney from you? Or just the fact that he represents you gives him the power to act on your behalf?
    All he needs is your agreement.

    Thanks LawResearcherMissy....I guess that was what I was afraid of...although a collector doesn't have to work with a settlement company, I'm assuming they would HAVE to work with an Attorney...is that right?

    Nope. Unless you're referring to talking to your attorney when he tells them "Stop calling now, s/he's filed for bankruptcy".

    No law requires creditors to settle for a penny less than what you owe, and there's no requirement for payment arrangements either.
