    Question No Radar, is Cop's Word Enough

    My question involves a speeding ticket from the State of: california, I ride a motorcycle, Sport bike to be a little more specific, and i was in the carpool lane on the freeway and the cop said i was doing 90 in a 65. On the ticket he put two violations, 22349 (A) vc - Max Speed and also 5200 vc - No Plate

    Both not correctable ... He did not have me on radar and where/when he got behind me it was Double Yellows his lights were not on as he crossed them. I was in different city than where the officer was from. Two days later i got a notice in the mail that says (exactly as it say on the paper)

    Violation section(s) should be changed from COUNT2 CVC 5200 to CVC 5200A

    I am on a motorcycle i dont understand this code. How should i fight this. or should i even attemp to?

    The 5200 could be correctable. (I'm not near my laptop, I can check later). Or either wait for the courtesy notice OR check with the court.

    Officers are trained to visually estimate speed (and typically fairly accurately) and barring a challenge from you supported by some evidence or reasoning that he was wrong, it is typically acceptable by Cal;ifornia courts.

    And???? officers are above the law!!!

    Kidding, stop and think about it; as he chased you, he was speeding as well, but that does not negate your speeding violation.

    He amended the no plates/registration violation from CVC section 5200 to CVC Section 5200A. But see by doing so, he might have screwed up.

    Question is, how many plates does the DMV issue for a motorcycle?

    Here is CVC 5200(a) & (b)
    5200. (a) When two license plates are issued by the department for
    use upon a vehicle, they shall be attached to the vehicle for which
    they were issued, one in the front and the other in the rear.
    (b) When only one license plate is issued for use upon a vehicle,
    it shall be attached to the rear thereof, unless the license plate is
    issued for use upon a truck tractor, in which case the license plate
    shall be displayed in accordance with Section 4850.5.

    You're right he screwed up. You should beat the tag thing... but the 22349 is gonna be tough. It can be done, but I'd do traffic school if available.

    i cant prove my speed like he cant. we both got onto the interchange to the same direrection except he took the regular exit, i was in the carpool exit i came out of the interchange way ahead of him i saw him in my side mirror. he was also behind car in his exit. so if he's basing the fact that i came out of my exit before he came out of his. would that constitute speeding?i had no vehicle in front of me. he did. feel free to ask me anything i just got my courtesy notice says traffic school fee $534 or bail $485. i bet if i had a cruiser i wouldnt have gotten pulled over lol. he also told me that i opened my bike up after the interchange....no disrespect to anyone anywhere but if i had he never would have pulled me over...

    Maybe that's how you caught his attention, I don't know...

    If he and the vehicle that was in front of him were driving the speed limit, and assuming that both of you were driving the same distance, then yes, that constitutes speeding!!!!

    Had you opened up your bike and assuming he was unable to catch up, it would make sense that "he" couldn't pull you over. He does have a radio though... I bet you that signal is faster than your bike. And at 90, 100, 120 or whatever, its hard to see a CHiPer waiting for you up the road!!! Always keep that in mind.

    i never went above 84 cuz i knew he was there the whole time.....he put 90. i am on a super sport bike and by opening up i could have hit 165 easily,....

    Could be that "super" part that got you the extra 6 miles...

    84mph in 65mph is the same fine as 90mph in 65mph, so I'm not sure why your feelings are hurt!

    I used to ride motorcycles a few years back. You know why I stopped?
    Because it got to a point where there was absolutely no conceivable way that I could continue to ride for much longer... I was gonna either lose my license... or even worse... So I sold them both.

    Now, I just go to Barnes and Noble and flip through all the motorcycle magazines there...

    traffic was going just as fast as on on the freeway i got pulled over on me....thats why im like WTF o well, ill be in court for it....
