Guardianship of a Grandchild

My Mother in law and Father in law have had there 13 year old Grand daughter living with them for over a year now ...The Bio Mother is in Prison and the Bio father of the Child is in A Drug Rehab place, in another state.

She needs to get Gaurdianship of her Grand Daughter
how can she do this with out having to pay 3 grand to get this done ..can she petition the court for it herself.??

The Bio Mother did a Notorized Statement before she went to Prison to give the grandmother rights to take her to the Doctor and for school and stuff
But the Prison will not let her have any Visitation with her Mother unless the Grandmother gets Gaurdianship .....can the bio Mother do this from Prison?? What about the Bio father ,...they can not even get hold of him because he is in rehab or Jail all the time

what does she need to do??

The grandparents should be able to obtain a guardianship themselves. There are some instructions here which should be helpful. They can probably obtain the required forms from the court.
