Default What are a Potential Father's Rights
My question involves paternity law for the State of: Missouri

My son was in a relationship last year for a short time. The person that he was involved with told him this year that she thought she was 6 months pregnant but if it she was earlier it was someone else but if she was exactly this far then he could be the father. She convinced him that she would give the baby up for adoption and they both signed papers but she changed her mind. (Why he signed papers without knowing if he was the father or not is beyond me) They never got along in fact he found out she told someone else the same thing as far as being the father. Needless to say they do not communicate anylonger. She will not agree to a paternity test and she did not put a father on the birth certificate that we are aware of. If she never persues to find out the true identity of the father and yes I do believe she is on some type of state assistance, what will happen if she never even gives the state his name? What will he be responsible for if in 5 years she states he is the father now? Will he be paying back child support for a kid he never knew was his? Any advise?

If she doesn't give them his name, it is not likely that they can do anything. She would have to give them information about the father of the child to receive any benefits, however.

She will likely only get support dating back to the date of filing for child support.

He knew that there was a possiblity that it was his child.

Honestly, he needs to file with the court to determine whether or not it is his child, not wait for her. She doesn't have to agree with the paternity test if the court orders it.

If he believes that she is recieving public assistance, he can start by contacting DFS. Then if he needs to he can file a petition in court to establish paternity.
