Question Paternity Fraud
My question involves paternity law for the State of: Virginia

In spring of 06 my then boyfriend told me that his ex notified him that she was pregnant and he was the father. I accepted that. He started giving her money to get necessary things and to help with medical bills. Well, she never kept set appointments to get together to discuss name choices or how they would raise this child, which bothered me a lot, nor was he ever told of any dr visits.She just found reasons to avoid him. He is in the military so his hours are long and he relied on information from her. Well, around the due date he got a voicemail saying his child had been born, but had health problems and died, which sent us both into immediate alarm. He inquired about funeral arrangements but she wouldnt answer. She only gave him what the sons name was. I had red flags popping up the entire time, but he really wanted to believe it.In the meantime, he was depositing money into her account monthly. He decided to stop sending it finally, way longer than he should have waited and she was livid, saying "you didnt want him anyway" and it prompted him to keep sending it a while.
Now, 2.5 years later we have been married a year and he is deployed. He recently called his voicemail on his cellphone and had a message from a small child saying "I love you daddy" you could hear a female voice that sounded like her, telling this child to say it.
Now he wonders if she had the child and didnt want him to know it and he wants to find out the truth. I think she is just after more money because he was an easy target.
If we find an address, can we do a petition for paternity without contacting her and how would we know a birthdate for this child if it does exist, or can we use a date range when the child should have been born. I think this is a sick twisted individual trying to twist the knife a little harder on an already painful past.
This woman received over $10,000 in payments and we dont know where the money went.

If this is untrue, can he pursue criminal charges for fraud or obtaining money under false pretense?

Your husband can certainly file to establish paternity if he wishes. Of course, he should ask the court to order a DNA test just to make sure.
