Default Public Consumption and Underage Possession Ticket
This is for two tickets i receieved in Queens, NY last night. I'm 20 right now, I'll be 21 in about 25 days but that probably doesnt matter.

I left a friends house with a black grocery bag with three beers in it and was carrying an empty on i finished on his front porch. When we were walking back to our apartment we were stopped by police and I was issues two tickets. One was for possession of alcohol under 21. On that ticket the issuing officer wrote down my license information but when he wrote my address and state he wrote NY instead of NJ. Everything else is right on the ticket. Is this grounds for getting it dismissed? And for the Public consumption nothing was wrong on the ticket, so does anyone have advice or know what the usual consequence is for it?

Thanks.

It's a minor clerical error, and won't get the charge dismissed.

If the Public consumption is the same as an open container the fine is 25 buxs. I am only guessing I assume the other might be more b.c it's underage drinking. Maybe they will give you some community service plus a fine. You can ask about an acd for the underage drinking, there might be a legal aid in the court who can ask the judge for you. I got an open container ticket and the fine was 25 dollars. The called you up in front of the judge and there was a legal aid right next to you. I noticed some ppl got an acd or a dismisal if they were lucky.

Does the fact that I haven't been in trouble with the law before factor in? And im sure this wont matter, but does the fact that i'll be turning 21 a month prior to the court date help at all?

I'm pretty sure there both Just volations and not criminal offenses. Since you never got in trouble maybe you can get an acd (it would dismiss the ticket if you stay out of trouble for 6 months.). If your going to the court in manhattan, they prob just say you can plead guilty and pay 25 each or so.If your lucky they will offer you an acd for one or both. There should be a legal aid there you can talk to for a second and ask for advice. It might be worth it to take to a lawyer who has a free consulation.
