    Default Disability and Divorce

    My question involves divorce in the State of: Florida

    I have a serious health problem and have just recently been approved for Social Security disability benefits. My wife and I have been married for 19 years. She has been working for a fast food establishment for 24 years. She is always at work, which has been a major part of the problem. We have not been remotely intimate in any way for over 3 years. Because of my health problems I have also had to recently file for bankruptcy since I have not been able to work for over a year. My 14 year old son also receives $608.00 montly benefits due to my disability. Does any of that money he receives from the Social Security Administration count toward any type od child support that I may have to pay? Are there any special stipulations in Florida divorce laws concerning my situation of being disabled that may help me? I may ask for either primary custody or equal custody due to the fact that my soon to be ex wife is always at work and I would be able to spend more time with my son.

    If you are ordered to pay CS, the benefit your son recieves can be credited toward the guideline amount of CS. Example- guideline amount is $700.00 then the $608.00 is credited, you would have to pay the remaining $92.00.
