Default Ex Wants Car Repossessed But I Do Not - Do I Just Make Payments
My question involves an auto loan or repossession in the State of: Vermont

Ex wants to have a car repossessed that is in both our names. He is primary borrower and does not want the debt and does not care that I have offered to make payments. He just wants to file bankruptcy and start to repair his credit. Can he still have it repossessed or can I stop it somehow. I have been making payments but he is still planning on having it repossessed even though there is a court order saying he is responsible for the vehicle payments? What should I do?

With a court order making him responsible, as the primary borrower, for the payments, I believe he can, yes.

Get it refinanced into your name only. That will relieve him of the debt and you of the worry that you're going to find your vehicle gone in the morning.

The court order - I assume your judgment of divorce - gives him responsibility for the payments, but under the order who gets the car?

If he's not making payments as ordered by the divorce judgment, it may be possible to have him held in contempt by the divorce court.
