Fiance's Name on Birth Certificate-but is Not Biological Father
My question involves paternity law for the State of: North Carolina
My fiance is not the biological father of my unborn child. We both want the baby to have his last name and for his name to be put on the birth certificate. How do we go about doing this? Could we just go ahead and put the name on the birth certificate? I am due May 26th 2009.
(Biological father is NOOOT involved)

So you want to commit fraud on the birth-certificate?? No one here will help you.
But if you decide to commit this criminal act you should peruse the criminal law forum so yo know what sentence awaits you.
If BF would like to ADOPT the child he should first MARRY you and then, about a year from now, consult an attorney to help.

Yes, you did. You mentioned putting your fiance's name on the BC although he is not the child's father. That, my dear, if fraud.

There is no "buts" about it. This was my decsion. He is not fit to be a parent, therefore he will not, under no circumstances, be around my child.

Youre right I did MENTION putting his name on there...but what Im trying to get you people to realize is HOW DO I GO ABOUT DOING IT LEGALLY IF I EVEN CAN AT ALL!!!!! Which is why I asked "How do I go about doing it." No one has yet to answer my question. If yall dont know the answer, then don't even bother with your petty smart ass comments. Thank you!

Actually, Bay did answer you. Get married and have fiance do a stepparent adoption according to your state laws.
You do realize that if the father does file for paternity/custody/support/visitation you will not be able to dictate whether or not he sees the child, right? He has to be proven unfit by court standards, not yours.

WWHHOOOOOAAAA there girlie. You have a lot to learn about being a CO-parent. The bio father is also a parent and, until, unless, a court removes his rights, has as much right be be an active parent as you do.'
It's not your choice.
So, yes, now we are definately talking about fraud. That clinched it.
and to how to legally put your boyfriends name on the BC and not the real father? There isn't one.

Thank you. Finally someone is giving me helpful information. I was not aware that he has to be proven unfit by the court. I will be the first to admit that I am totally clueless on what the legal process is in this situation, which is the reason why I came on here to ask questions and to no be be-littled. Thank you again.
