    Default Parental Rights Terminated and Still Being Charged

    My question involves child support in the State of: California

    Hello everyone, I need some help.

    3 years ago, the biological mother (and custodial parent) had me terminate my parental rights as she had her husband adopt my daughter. I know support is susposed to be charged until the adoption was cleared, but I am still being billed. The court people told me I would not be notified about the adoption being finalized, and I have not heard a word from the mother and the phone number I have is no longer any good. Unfortunately, I have also lost my copy of the form I signed since then.

    Since then I have changed jobs and am making much, MUCH less than I was when this first started, and have not been able to afford the payment.

    So my questions are:
    1. Am I wrong about not having support obligations after the adoption?

    2. Is there a way to find out if the adoption failed to go through?

    3. How do I go about getting all this fixed? I know I will probably need a lawyer but there is no way I can afford one.

    Any help or advice would be appreciated here. Thanlks in advance.

    You need to file in court to stop the CS ASAP.

    IF the adoption was never finalized, they will have to prove that in the hearing.

    but, be aware that if there were any arrears, you would be required to pay until those are paid and if the mom was on any state aid, you would have to repay that.
    I am not an attorney and any advice is not to be construed as legal advice. You might even want to ignore my advice. Actually, there are plenty of real attorneys that you might want to ignore as well.

    I'm going through basically the same thing. My son was adopted unbeknownst to me a couple years ago I'm guessing and sorry to tell you but..Get ready for ZERO help via CSS...I tried a low cost alternative to getting this taken care of and it was a waste of time and money and the only real help you are going to get is to hire a good lawyer. I spent 5 months with the low cost alternative to get to where my lawyer got to in 2 days!!! Yes it is expensive but..Things actually happen!...Good Luck!!

    I've never had to go "lawyer shopping" before. What should I look for?

    As others have said though..If you owe arrears thats probably what your paying..If it's accruing every month like mine is..There's a problem.

    It is accruing every month still.

    What is the "it" that is accruing? Monthly support or the INTEREST ON THE ARREARS?

    Did you ever attend the adoption hearing? Did you go to the court and get a copy of the termination of parental obligations? Did you move to have the child support terminated once you went to court? Did you do anything or did you decide you were going to let someone else do it all until the $$$ became an issue again?
    If you wanted babies all to yourself, you should have created them by yourself. Until you do that, children have the right to BOTH parents, especially since you found them suitable to procreate with.

    Sorry my last post was short, I was in a hurry. The "it" is my monthy requirement which is still being charged. I was given a copy of the termination form after I had signed it, but it has been lost. After I signed the form, I was told by the court personnel that was handling the form that the child support would stop after the adoption went through, and that it could take a long time. Since then, I have heard nothing from either the courts or the mother. I have never seen any dates for hearings or anything else of that nature.

    you need to file with the courts to have the order of support terminated. Do not count on the courts in the adoption situation to take care if it.
