Default Workman's Comp and Vacation Hours
My question involves workers compensation law for the state of: Illinois
My boyfriend has been off work for three months due to an injury received at work. Up until his last pay period his vacation was acruing but now they have taken it all back claiming he is not eligible for the hours becasue he is not working. Does anyone know what the laws are regarding this? We have have heard conflicting stories from people we know that have lost work time due to work related injuries.

When you're not working, you're not working and it's legal to not give you vacation time. The rest depends upon the employer's policies - some employers voluntarily extend benefits to injured workers that aren't required by law.
