    Default Taxes and Child Support of Husband-To-Be

    My question involves marriage law for the State of California.

    Hi,

    My fiance and I finally decided to get married next month. I want to know if after I marry him and take on his last name, will I be half as responsible for his debts - taxes owed and child support?

    I have always gotten tax refunds and I am worried that I will stop getting it after our marriage takes place

    How should I file my taxes once my status changes?

    Does he owe back taxes?

    If he does, you really shouldn't marry him until that debt is paid off. Although the IRS shouldn't be able to come after you, the IRS is known for ignoring the laws and coming after spouses who are not responsible for a tax debt. Then you'd end up having to spend alot of money for an attorney and fight for years to get it straightened out, even if you file seperately, or file an innocent spouse form with your joint tax return.

    Does he owe any CS arrears?
    If he does, or falls behind, the CSE can levy any joint accounts, or any jointly owned assets.
    However, your income cannot be included in determining the CS that he pays.

    If you want to marry him before the debts are paid, you should make sure to never co-mingle your income and assets. Keep seperate bank accounts, etc.

    Yes, he does owe a bit.

    How do I file the innocent spouse form with our joint tax return? Can I just file seperately?

    I just know his paycheck gets deducted with Child Support.

    We don't really have any joint accounts or assets and I think I'd keep it that way for a while. Almost everything is under my name.

    Is it ok for me to carry his last name or just keep my name as it is?

    By the way, I can't wait for him to payoff his debts because I am signing up for the Military soon and before I do so, I want a "married" status
