Question Father Abandoned Me and Our Unborn Child and Joined the Military
My question involves paternity law for the State of: Utah

My ex-fiance proposed to me, talked me into a baby, got me pregnant, then abandoned me and our unborn child and joined the national guard. He left me with the full financial burden of everything we shared including the expenses of this pregnancy and has refused to contact me.

I'm half way through the pregnancy, he's in basic training, and i hired an attorney to prepare and serve him with a paternity action while he's in basic training. Does anyone know what i can expect to happen now? Will he have a time frame to reply? What if he doesn't respond? Will we have to go to court?

Thank you for the link. I've read over the site a number of times and I just feel like I'm in the dark still. I guess what my questions are.... While the culprit is in basic training will he be required to deal with the paternity action I'm having him served with? Will he be provided with a military attorney? Once he's served in basic training what are potentional scenerios of how this could play out? Say he denies the child is his (he's verbally acknowledged it's his to his batallion commander) and he refuses to sign the paternity acknowledgement form... it then becomes a court issue, right? well he's in basic training then off to AIT, will he beable to delay court until he's done with AIT and back in the state doing his weekend a month with the national guard. My concern is he'll be deployed before all the paternity issues (custody, child support, med. insurance ect..) are resolved and they'll be put on hold. That's why I'm filing the paternity action now during the pregnancy as opposed to after the child is born.

For the safety of the child, it is hyper rare for a paternity test to be conducted until after the birth of the child. Of course it never hurts to get as much done and paperwork in order ahead of time as possible, but it push comes to shove and he remains in denial, the DNA testing will have to wait until after the blessed day.
