Unhappy Fraud in New York
My question involves criminal law for the state of: new york
question: if i received a "gift" of a few thousand when (ny state mistakenly closed my case) did i have to report it when 4 months later my case was reopened?? i mean i had to survive on that money.....now....i was hired as a temp in jan... and didnt report it until march... now fraud is after me and im frightened... i have a sick husband and a 14yr old and quite frankly my job doesnt pay much.... its like damned if you do and damned if you dont situation!!! will i go to jail??? and how can i pay back any monies and still be able to live????

If you were legally obligated to report the cash when you reapplied for benefits, then you were legally obligated to report the cash. We don't know anything about your situation, so we have no way of answering further.

If by "fraud is after me" you mean that you're being criminally investigated then it stands to reason that yes, you were supposed to report the cash. Have they told you that you might be able to resolve this without charges, for example by returning the benefits you wrongfully obtained?

im sorry mr know it all, i wasent very clear....
ill try to keep this brief... first... ive worked most of my life... second, i moved from florida back to new york and i needed a little help until i found a job. i applied for aid and within 2 months they closed my case (erroneously) by the time they realized their error, i almost lost my apt and had to rely on family to help support me. my aunt gave me a gift (while my case was closed) and i did not have to reapply... they automatically re-opened my case. i do not want nor am i asking for pity but to be honest with you sir,, my husband (due to transfusion) has hiv.. i was just hired as a temp in jan. and i didnt report it.. ( i know i should'ved) they mailed a letter to me asking if i was working and i wrote no...they gave me an appt (fraud), i called and told worker the truth..so now i sit with bated breath and await my fate....also, will they take away my 14yr olds savings??? i did not report it b/c it isnt my money..
