I need to know if i require the bio mothers concent to change my 12 year old daughtors last name i have coutody and the bio mother is incarsarated on three life counts no parole possable at this time.

Unless the bio mom's rights have been terminated (and bringing such an action may be possible, since she is incarcerated), yes, you still need her permission.
