Possession of Marijuana While on Probation

about a month ago my home was raided in suspicion of drug activity. The police arrested me for possession of marijuana and also booked me for the same at the county jail. i was caught with half a joint and my father was caught with about 5 grams... i recently called up to the courthouse where they told me BOTH me and my father had warrants for possession of marijuana..

my question is..me and my father are going to the arraignment soon and was wondering if id have to plea then...and if so what should i plead..

im currently on felony probation for home invasion and on HYTA status so what should i plead?
and what should my 55 year old father plead who hasnt been in trouble in more than 25 years?thank you

Due to the fact your on felony probation your best bet is to contact an criminal law attorney asap so you can discuss your options.

well i went to court today and when i got to the criminal division they also charged me with maintaining a drug house? so I hired a real good lawyer and he told me he had an idea on how to fight this in court? can anyone tell me about this charge ive never really heard of it thanks

Well, if they raided your house for suspicious activity, then theyve probably been watching for quite some time. I am not sure exactly what the ramifications of maintaining a drug dwelling are. I was always under the impression that it was the maintenence of a house where drugs were being manufactured or sold. If this was going on in your house, then that is a bad thing, because if the law knows about it, then you are in some serious trouble. However, if you can prove that you and your father were simply smoking in the house, and that you didnt have a stash and a scale in the back, I think you will be alright as far as the drug dwelling charge.
But as far as simple posession, if theyve charged you, theyve got you.

This isn't true. Even though you've been charged that doesn't mean anything until you've actually been sentenced. Millions of people are charged but never convicted.
