    Question Questionable Speeding Ticket

    My question involves a speeding ticket from the State of: Tennessee

    I got pulled over and received my first speeding ticket. I was driving along the interstate at 55mph when I see a cop on the side of the road. I didn't think anything of it because I was well aware of my speed. I double checked it and sure enough my speedometer said 55. There are also several other cars in the pack with me, with about 2 that were passing me at the time, including an ambulance. There were 2 lanes of traffic between my car and the patrol car.

    Next thing I know, here comes the cop, with his lights on. So I get over thinking he was going to get one of those who had passed me up. Nope. He gets right on my back bumper. Puzzled, I pull over. The officer walks up to my car and says, "I'm Officer ...., I clocked you going 76 in a 55. I need your license. Please have your registration and proof of insurance out when I get back."

    I am freaking out because he was accusing me of something I know I wasn't doing, but I don't argue because I didn't want to tick the guy off, plus I've heard not to argue with them there, take it to court. I'm just afraid that since it's my word against his word, it won't go my way. Any advice on this?

    Plus, one of my friends told me to check the survey to see if 55 is a justified speed limit. How do I get the survey?

    You can explore getting a survey with the government agency that administers the road, for whatever unit of government is responsible for that stretch of road.

    Are you suggesting that the officer just made up your speeding offense?

    No. I'm suggesting that when he used the radar, he could not have been 100 percent sure which car it was. He just picked one out of the pack. However, if he would have noticed, that by the time he got up behind me, the other cars were way ahead of me. I was only suggesting that he assumed that was my speed just because he tagged a car in that group. But as I said, they were passing me at the time, so I don't think its fair that he assumed it was me. He should have seen that the other cars were farther along that me. The only reason I say this is because there were 2 lanes of traffic between my car and the officer. There is no way he could have tagged my car with those cars there.
