Default Joint Ownership of an Auto in New Hampshire
My question involves an auto loan or repossession in the State of: NH


My ex-fiancé and I have a vehicle that is titled in both our names. I am the primary purchaser and she is the co-purchaser. The title and registration reflect me as purchaser "X" and her as purchaser "Y" Due to her credit rating she is unable to obtain a loan in her name to buy me out of the car.

I would like my name off the car and need like to know what my options are. She did provide the down payment on the car and has been making the payments since we bought the car, but that is only because I paid all the bills (except the car) while we were together.

At this point I guess my questions are:

Since the car payment is in my name and the bill is coming to my house, if I take over the payments can I legally take the car back, I would rather take the car back and sell it than wait for a default notice (based on her credit, I know it will be forthcoming).

She has ignored all my letters and e-mails concerning property transfer so what is my next step?

This issue is about a month old but I don't want to wait for a default notice before I take action.

unless there is an "or" between the 2 names on the title, the only way for you to sell the car is to have the other person agree.


just put this in the list of things never to do along with;

do not buy a house as joint owners with a girlfriend/boyfriend/ fiancee/friend/relative unless you are willing to fight to the death over it should the relationship sour.

Do not co-sign anything for anybody unless you are willing and able to make the payments should the main debtor fail to make the payments, as well as understanding you will not being able to take possession of the item.
