Non Working Wage Loss
My question involves workers compensation law for the state of: Ohio
Here is my question and details. I was working as a seasonal warehouse worker. I suffered an injury in November for an intercostal strain. Actually, I had a torn rotator cuff and no one found that. Not the ER doctor or the work comp doctor who was handling the physical therapy. We all realized it about the same time and it was found by mri 2/10/09. Anyway, the first light duty they gave me aggravated it, in fact I couldn't even use my right arm at all during that time. So, when I went back to the doctor she upped the restrictions. They gave me a lifting job ??? and when I told the private insurer, the rep said to ask for the job they were giving me in writing and I did. The didn't respond, I called in everyday and was fired for occurrences. That was December. I have tried for months to find a job, online and hitting the streets. I've been on about 10 interviews and I am not getting calls back. So, can I get non working wage loss even though the "season" would have been up the end of December? Right now there is a hearing, they denied the add'l dx, I have an IME coming up and my lawyer (who is real hard to get to talk to, why I have this questions) did ask for any compensation or benefits. Would that include wage loss? His assistant said "that's your problem" when I asked about lost wages. Is that correct? I have monetary obligations toward my friend who has let me stay in his house for the last 5 months. Another friend stays on the weekends and he helps with gas money. I have used the pantries so far and have an appt soon with food stamps. I hate that.
