Default Duplicate Charges On A Credit Report
Im trying to settle a debt on a student loan however Im not sure with who I should be negotiating to clear it off of my reports.

The debt is listed twice once with Wells Fargo and then what appears to be a debt buyer. I know it is the same debt because the collector states so in his comments on my credit reports.

First is it legal that two separate entities show a charge off for the same debt?

How can the Buyer list it as a charge off on the same date that they purchased the debt? Doesn't he have an obligation to contact me?

This student Loan was with Wells Fargo and was a part of a divorce settlement that included three loans with them. A Mortgage 136k an equity line at 25k and this one at 12k. The mortgage and equity line were wiped out without missing a payment as a pre-req for the finalization of the divorce. They were absolutely unreasonable about this loan being in court and listed it as a charge off before a decision on the divorce was even final. Decision took 5 months with the sales of property and this charge off was made 3 months into the process enabling them to slam myself and my ex with the same charge off. and it shows twice on both of our reports looking like we each have some huge amount of debt. CRAZY. There should be some time requirements on how long they have to pursue before they charge off! and boy was the lady their the most foul mouthed individual Ive ever dealt with!

Is there a time requirement for a creditor before he can damage you?

I need to settle it though cause life goes on. Who should I negotiate with to get the other party to remove as well? Should I negotiate $ for $ or less?

Try negotiating the debt with its current holder, and see if they will withdraw the write-off as part of the settlement.
