    Unhappy Current Mass Resident, Soon to Be Cali Transfer W/a New Hampshire DUI Conviction

    My question involves criminal law for the state of: California/Massachusetts/New Hampshire

    I am a Massachusetts resident who was convicted of DUI in the state of New Hampshire. I initially had my license suspended for 30 days for refusing a breathilizer, however never received any notification from the Mass DMV. I plead guilty and was given a fine and license suspension of 9 months. I am moving to California in a couple of months. Is the license suspension only valid in New Hampshire, or will it affect me in both Massachusetts and California also? And will I have a problem transfering my Massachusetts license to California? I was given the option of taking a 1st offenders course and getting my license back in 3 months versus 9 but the arresting officer suggested I look into whether or not the suspension in New Hampshire is reciprical to the state of California before doing so. I am not sure whether or not it is. Anyone have any idea?

    The Registry will be notified about the DWI in NH and your MA license will be suspended because of it. As it stands now, NH has suspended your right to operate. This basically means "everywhere" for all purposes. In other words, if you get stopped in MA and they run your MA license number it comes back fine as long as NH hasn't notified us yet. However, if they run you by name and DOB....they will se the suspensin in NH and you can be arrested for operating after suspension. If you did not take the first offender program, your MA license will be suspended for one year due to the conviction on the OUI charge and 180 days for the refusal. No State will issue a license to you right now if you are suspended in NH. Where in MA do you live????

    go to the Worcester RMV or Springfield...)whatever is closest). See a hearings officer and ask that they apply this to your MA record now to start the time running. Also ask them about the Mass first offender program and if the one in NH will be recognized in MA. You really need to look into completing the MA alcohol class in order to get the time of the MA suspension reduced. Try to complete everything before moviing to CA to make it easy on yourself.
