    Question Rental Management Company Rip Off

    My question involves real estate located in the State of: Kentucky
    We bought a house and then got orders to PCS, so we used a rental company to handle our house. They moved a family in with the agreement of 850 a month. After about a month and a half they said the woman is under Sec 8 so we would have to go through the state for payment (being the holidays our payment would be late but paid in full for the 2 months). They only received 300 of the deposit (which was supposed to be atleast 425 to move in and 425 at the next payment).

    After supposedly submitting the paperwork to the state, they told us in order to the state to pay us we would have to lower the rent to 720 and do all kinds of repairs to imaginary problems, which we said no, get her out. This company didn't even start the eviction process till she had been occupying for about 2 1/2 months with no payment. After all that headache, they told us that per her credit, she wasn't qualified to rent through them but she had a good report with their company, and that the sec 8 paper work was never submitted.

    So now she lived there for over 4 months and they just now got her out, after continuously telling us that everything from the ceiling fans to parts of the foundation needed to be replaced saying they needed outrageous amounts of money to "make the place livable" when it was in great condition and passed all the VA inspections not even 6 months before. They are now saying they can only sue her in small claims for 1500 even though over 3400 is due for the time she occupied plus the 850 security deposit that was never received and they already said the repairs were unnecessary that the company they hired to look over the place was making things out to be problems that weren't (which i knew they were ungrounded claims for nearly 1500 worth of work)

    All this bs has put us into foreclosure, and this company refused to give the keys and inform our Realtor that she could now show the house for short sale. What can we do to recover our losses due to the incompetence of these people??? Are we suppose to sue this woman as well as the rental company? I'm sure i've left out some info since i am truly heated right now, so please HELP!!

    You can sue your ex-tenant, who no doubt is a penniless deadbeat who doesn't have a cent to pay you with anyway.

    I have no way of knowing if you have any sort of claim against your management company. Unfortunately, I doubt it. Run your contract and the detailed facts past a lawyer.

    If it were me, I would file a claim against everybody and let the court decide who it at fault. You need to speak to any attorney and ask the finance company for a forbearance on the note.
