Default How Do I Bring Charges Against Someone for Domestic Violence
My question involves criminal law for the state of: Ky. A friend of mine who is married but legally separated from her husband went to pick up her kids from her husband's house and when she did he slammed her up against the wall and choked her. She went to the police station to file a report and they said that there was nothing they could do for her. I don't understand how a man can get away with assaulting a woman half his side when she had marks on her arms and on her neck. Could you please explain this to me?

We can't say.

Did they say WHY they were unwilling to take a report?

Did she ask to speak to a supervisor? If not, she needs to do this asap - the more time that passes between the incident and the report, the harder any followup will be.

She can also go to her doctor or the hospital and tell THEM what happened and let THEM call police to take the report (harder for police to blow off the incident when more people know about it). Medical attention is also important not necessarily because she NEEDS it, but because of it's value to have any injuries, marks, etc. documented by a third party.
