    Default Claiming a child

    I have a 11 month old daughter and I was wondering who gets to claim her during tax time. Her father and I are not together and haven't been since I was pregnant. She has lived with me all this time. We have no custody arrangement yet, but we do have child support going. Her Father pays $450 a month. So does he get to claim her or do I get to? Thank You.

    Dad2 is right, you have the rights to claim that child first, since that child has lived with you since birth. It doesn't matter how much child support someone pays to their ex, if the child doesn't live with that person for at least 6 months out of the year, they are not allowed to claim the child.
