    Default Can the HOA Threaten My Tenant

    Hi,
    I own a home in a Florida gated community which I have rented out. My tenant just called, scared to death, saying that the HOA president just knocked on the door threatening to deny her gate access if the dues are not paid immediately. (They were due in January, but times are extremely hard right now, and we just can't pay them for a few months. But I have always paid them on time in the past, and I DO intend to pay them, but right now it is a low priority)

    My question is, does he have the right to threaten my tenant? Even telling her to deduct the money from the rent and give it to him! I told her to NOT do anything of the sort. That what he was doing is illegal.

    Is it and do I need to get the police involved?

    The president did nothing wrong. The FIRST people you want to pay is your HOA. They can file a lien on your property and force a foreclosure sale.

    The association is just trying to collect on what you owe them. This is a civil matter and the police will not get involved.

    Ok, but I am still unclear on whether or not he can change the gate code on her. That does not seem right!

    They should not be willing to go that far, however, I have seen it done in the past. Cant you call a neighbor and get their gate code and give it to your tenant just to be safe?
