    Exclamation Visitation Issues Ohio

    This is for my fiance, he got court ordered visitation back in august of his 5 year old daughter. from the start it was bad on the mothers part. she was constantly making excuses to cancel visits or just not calling all together. towards november though she was allowing his daughter to stay with us for a few hours at a time without her even being present, then all of a sudden she wanted visits at a police station stating when his daughter returned home form our house she would act up and the mother didnt like that and also she never wanted to leave to go home while we had her for visits because(in her words) mommy never plays with me. now she is taking him back to court to terminate the visitation all together stating he is an angry and violent person. granted he has a bad history and a record but he has never been convicted of anything and hasn't had any police reports on him since 2005 and that is her only proof of why is he "violent" he wants to know if that is enough to cancel his visits. he goes to school full time and works full time and all we want is visits with his daughter without the drama her mother brings around. any adivce on what he should do when he goes back to court or if its grounds to cancel the visitation?

    Has she already filed?

    If she has, your fiance really should hire an attorney if he can. If he can't, he should get a consult with one ASAP.

    From what you've posted, it doesn't sound like a Judge would cancel the order, but he should be prepared anyway.

    Does he have documentation of the times that ex has refused to allow the court ordered visits? If he does, he should bring that to court.

    Does the visitation order specifically spell out the days and times for visits?
    If he does, he should make sure that is enforced. If the order isn't specific, he should request that the order be made specific.

    yes the date and times are specifically stated in the court order and we have numerous dates noted in our notebook we have been keeping where she has canceled or not even called at all. we would have called her but when she did call her number was always restricted. we are in the process of filing a contempt of court motion against her that would be considered at the court hearing they already have scheduled. we unfortunately cannot afford an attorney but he is going to apply for a court appointed when he goes to court next friday.
