Default Assault and Battery By an Adult Against a Minor
My question involves criminal law for the state of: Virginia

Ok here's the story and exactly what I'm going to start off telling the judge it was over a girl . He is only 15 and I'm 19 but he is over 6' 200 and I'm 5'8 135. And I did it with people around and FAKE friends so I think they might all go against me in court... 5 or 6 of them.

What happened was I ran up on him at a public store I told him anywhere I seen him it was on and I stuck to that word. He wouldn't meet me alone anywhere so it was the only choice I had.

I stopped and looked at him after I got done running starting walking towards him and he ran behind his girlfriend I asked "what kinda shit is that?" then he replied "**** this" and swung first and hit my arm and left a bruise which I got pictures of. If they go against me they won't say this is true though, but I got pictures of it. After he swung I swung back and missed then he tackled me.

After all the the "real" friends jumped on him and started beating the shit out of him and there was no blood though just lumps on his head and face. And after all that they started running and up till this point I had only hit him once then I got one last hit in and started running, however the store owner was outside and I slipped in the grass and he caught me while the others got away.

Now he went to press charges and if I recall I was the only one who got the papers for the assualt but the store owner seen all three of us. That's not bothering me yet because I know they're get charged as well eventually.

However I got a previous record of 2 Petit Larcenys. And I also got a wreckless driving ticket coming up on that same date, but that one will probably be dropped totally or dropped to a civil(non-crimial) ticket.

Do you think I will get jail time?

It could be worse if the other ppl get charged,in a lot of states if 3 or more ppl attack someone it can be considered gang assualt. Someone I knew got in to a fight and other ppl came in and he was charged w. that. If convicted of that it's years,you got be careful when you do things b.c the concious can be servere. It all depends if your gonna get jail time with this charge,you need to find a lawyer and follow his advice. Maybe the lawyer can help you out w. self defense agruement but once it's a whole bunch against one that can be hard to prove.The lawyer can arrange a plea deal for you.
