    Default Wrongful Termination

    My question involves labor and employment law for the state of: Ohio

    I was fired this morning for calling off because I need to take my child to the doctor. I did call off yesterday also because of the kid's illness. I have worked part time for this place from 11-02-08 in this time I have only ever called off one other time. Of course going to the doctor I will have a doctor's note, but she told me on the phone she was firing me because I needed to the time off to take my kid to the doctor. Is there anything I can do about this? Thanks for your time.

    Unfortunately, no.

    You have not worked for the company long enough for any labor protections to kick in... if they ever would (depending on the size of the company and number of employees they have).

    I live in Ohio also. I am not aware or any labor provision that forbids an employer from terminating an employee who had to take time off to attend a sick child.

    This was "probably" "without cause" as far as Unemployment is concerned, but to qualify, certain criteria must be met.

    If this is too hard to sift through, you can always apply in person or online, depending on how they work it now? If you were just part time, you may not qualify, and while your claim is being processed, you still have to actively seek work.

    Ohio is an employment "at will" state, meaning you can be fired for any reason not contrary to law, of course.

    There are carved out exceptions, whistleblowing, public policy, etc., but as stated, I am not aware of any law that would protect you.

    Sorry your employer is a tyrant.
