    Default Emancipation Under the Age of Majority to Stop Child Support

    My question involves child support in the State of: Florida
    My husband has received a pertition from Department of Revenue seeking child support from a previous girlfriend for her son and medical insurance. She was denied in 1993 because she refused a DNA test to establish paternity. My husband continued to share sporadic visitation with the other suspected father. My husband had given her money sporadically, as well. For the last 2 1/2 years we have consistently sent her money every month. He has failed the 8th grade 2x for inconsistent attendance. Last year his mother withdrew him from school and he worked full time until he was laid off and is now 16 going to be 17 in august and is reenrolled in an online schooling program that started in february of 2009. He is about to fail out of that, as well, for not doing his work and attending regularly.

    Can we have him declared emancipated so as not to pay child support any longer?

    No.

    Your husband needs to bring proof of all payments made to court with him. He should request that the payments be credited to any retro support that is ordered. In FL, retro support can be ordered back 24 months from date of filing.

    If the child is not in HS when he turns 18, your husband's CS should end at that time.

    Yes I got the same problem here in Texas a near 17 year old daughter in the 9th Grade ,failed twice ,pulled out of public school for failing and skipping school at G-Parents home moved back in with my Ex .Ex enrolled her into a Alturnative school for a month ,then checked my daughter out of that school and claims she in home schooling her thru a online program thru a a Colege.Will my CS end when she turns 18 or can this online schooling which I think is garb play a roll in it thru the courts?

    If paternity has not been established, and the other man could be the father, have you looked into fighting this?
