    Default Did They Agree to Pay Me

    My question involves business law in the state of: TEXAS

    I sent certified letters to companies letting them know I will be charging X amount of dollars for each call after a certain date, and the payment due date.

    One company continued calling with no intentions of honoring my terms, they were determined to keep my calls free. I was under the impression sending the certified letter stipulating when the charging would start, the cost of the calls, and the payment due date was sufficient. Did they not agree to my terms by continuing to call?

    were you providing some service to these companies or were you simply attempting to charge them for calling you as s debt collector would be doing?

    If you were already providing the call in service, say, for tech support and now wish to charge, you are, in effect, requesting they sign a pay to call contract, right?

    Yes JK they were a debt collector.

    No, you cannot charge them if they call you. They have a legal right to call you until you send them a cease and desist order (if a 3rd party collector). If they are not a 3rd party collector, the only limitation they really have is not to harass you, which can definately be an aribitrary decision.

    Further, what you are doing is trying to force upon them a contract by granting them a right they already have.

    Nope, you lose.

    Nice try though.... your letter probably made it up on the refrigerator in the debt collector's break room.
