Question Ex Hid Pregnancy During Divorce and Beyond - Where Does That Leave Husband
My question involves paternity law for the State of: Indiana

My son was divorced and Ex signed the papers saying she wasn't pregnant. He just discovered Ex had a baby 6 months later. It could be his, but she says it's the boyfriend's. She won't show pictures or birth certificate for BD or name of listed father. Baby is now 17 months old and he's never ecven seen it.

He wants to do whar's best for the child while protedting himself. Can she come back and get child support since it was conceived while married (nver seperated)? Does it matter who's name s on the BC?

Would he have a chance at joint custody if a paternity test said it's his? Does the age of the child matter since she's hidden it so long?

Does your son wish to establish paternity?

If he does, he needs to file a paternity suit.

He really should get a consult with a local attorney though, just in case the BF signed the AOP, which would make the case much more difficult.

Thanks for your help Zena;

He is leaning toward 'pretending' the child isn't his, although what little we've discovered says it's his.

What is a AOP? Would that be signing the birth certificate? We've asked to see a copy with only the parents and BD showing (for her pricacy), but tjey've refused. His attorney said it doesn't matterif the BF is on the birth certif-sshe can ask for paternity at any time and go after support. We read that he would have to pat, but not have visitaion under the
parental continuity law' if he waits ttil she goes for money.

My son is looking at the easy way out for all concerned (in his eyes), but I think the child deserved to know it's father. He thinks th BF will treat it unfairly if he discovers it isn't his.
