    Default Changing the Name of Father on Birth Certificate

    My question involves name change laws in the State of: Tennessee

    Ok when my 2 year old child was born i was married to my ex husband and he was not there to sign and did not sign her birth certificate but he is on it anyway and her real father (my husband now) wants to be the one named and have her named changed to his. But the man named on the birth certificated wants a DNA test and my husband (the father) don't want to put our child or himself through all that. What does the Tennessee state law state about this.

    Your ex husband is legally the child's father. The only way that you might have a shot at getting his name removed at this point is if you agree to do a DNA test.

    The child is two and probably won't even remember it. All they will do is take a cheek swab from the child, you (possibly, I can't remember) and the father. It is not painful.

    Tennessee law says DNA testing is necessary to contest paternity.

    The person you were married to at the time of the child's birth is the legal father, and will remain so unless and until DNA testing proves otherwise.
