    He didn't say anything to her. She messaged him on myspace but was possing as him (the bio). My husband called him and asked him (bio) what he was contacting him for and he (bio) had no idea what my husband was referencing. Now I don't even know if I should believe that they filed anything with the court?!? I really need to know what they did or didn't do because if they haven't done anything in FL I want to file up here so they have to come here for court proceedings.

    You might not be able to file in NC since you are still a legal resident of FL.

    Are you in the military also?

    If you are, I believe that different laws apply regarding jurisdiction if one party is in the military, but I'm not real sure of what they are.

    The best thing to do for now will be to get a consult with a local attorney who should be able to tell you if you can file in NC or not.

    Just a quick update:
    There is still no new activity for he or I in the Florida court system. I have spoken with numerous attorneys here in SC and they all said that we can file the adoption here. I have hired one of these attorneys and we are going to subpoena to bio by publication. I asked him for his address and he wouldn't give it to me. He said he and his attorney were working on something and that he would give it to me later. He also wouldn't give me the name of his attorney. I think he thinks if we can't physically serve him we can't do anything and he is very much mistaken. We're hoping that the bio doesn't contest the adoption and everything should be finalized in June. I'm sure he won't even see the subpoena by publication.
    Yes we are in the military. She is already my husband's dependent and on his medical insurance. There weren't really any problems that we ran into because we are military. Also, there was no problem with us still being FL residents. We have a home and both work in SC (him for the military) so we could have legally filed in either state. It was cheaper here and this way if the bio wants to fight this he has to come here.
    Thank you everyone for all your help and support and guidance. This website is a excellent guide for people like me who cannot afford to pay an attorney a couple hundred bucks everytime I have a question. Thank you again!
