Default DV Simple Assault in New Jersey
My question involves criminal law for the state of: New Jersey

My girlfriend and I were involved in a fight in which she was the primary aggressor. After I left the house she started to contact me that she was going to the police and they would never believe what really happened. As a result I went to the police station to see what me avenues where and while talking to the officer he saw my minor injuries and went to my GFs house to interview her. Our stories matched and the police arrested her and charged her with DV simple assault. I did not want to press charges and have since ended all contact with her. What are the chances that I can talk the DA or the judge to dismiss the case? I just want this to be over and go our ways. Thanks for the help.

You can always try to talk to the DA. You won't get to talk to the judge. Keep in mind that they probably feel they have a pretty good case, since both stories matched. Remember, the job of the DA is to bring criminal charges when they feel they can make a reasonable case that a crime in fact occurred AND can identify who perpetrated the crime. Once the police report is made, your role really becomes that of a witness.
