You can always try to talk to the DA. You won't get to talk to the judge. Keep in mind that they probably feel they have a pretty good case, since both stories matched. Remember, the job of the DA is to bring criminal charges when they feel they can make a reasonable case that a crime in fact occurred AND can identify who perpetrated the crime. Once the police report is made, your role really becomes that of a witness.
