    Default Shoplifting at Walmart in Tennessee

    My question involves criminal law for the state of: Tennessee

    I was stopped exiting Walmart for stealing some merchandise and brought to the Loss Prevention office (and detained there). They asked for identification and asked me to empty my pockets and filled out some paperwork. Then they had me sign a sheet of paper (essentially) saying that I would not enter any 'Walmart' again or else face Criminal Trespassing charges.

    After being held for 45 minutes a police officer showed up, filled out an incident report and wrote me a misdemeanor citation for 'Theft under $500.00'. I was not brought out in handcuffs but it is my understanding that this is the equivalent of an arrest. This is my first offense (for anything except minor moving violations) and I have yet to contact an attorney because its the weekend, but I had a couple lingering questions.

    1. Even though I was not took out in handcuffs, should someone have read me my rights since I was issued this misdemeanor citation and questioned by the LP officer?

    2. Should I contact the walmart general manager to inform them that I was held without being read my rights, or to ask if there is anything that can be done since I'm an otherwise law-abiding citizen who made a stupid decision?

    No. LPs are not required to read anyone the Miranda warning. They are not sworn officers and therefore are not held to that same standard. Don't bother calling the store manager. Loss Prevention and store management are two separate things in a retail store. The store manager most likely has no say in your case. You should consult an attorney.

    this is happening to me so what happened to u did it get dropped etc.
