Default Biodad Challenging Paternity of Non-Bio-Dad
My question involves paternity law for the State of: Virginia.

Long story very short,

I left for the Military while my ex~ishgirlfriend was 6 months pregnant. Because I left she got married and when she had the child he(X) was named as the father of my now almost 5 month old daughter. Completing my training and returning home(Reservist) I now want to establish paternity. Interesting side note, and my main question, she is getting a seperation and has filed for custody so how would my being proved the dad affect what she is going through? Would X continue to have any rights or pausibility of visitation to daughter, or would they all be revoked or whatever?

You may want to consult with a family law attorney on this one. Many offer low cost or complementary 1/2 hour meetings.

You can file suit to establish paterntiy- request dna test and then be ordered to pay child support. It will not guarentee visitation, so you might need to include visitation/custody in your request.

If the other person is on the birth certificate then he may be forced to pay child support for a child that is not his. He might then contest it and then she might decide to go after you. She would have to admit to the court she lied on the birth certificate.

This board can give you some good ideas, but there are a lot of real legal things to consider and an attorney is in a better position to spell it out for you.
