Default Can My Employer Do This
My question involves workers compensation law for the state of: ny
my employer had me go to their dr of choice and they said that i can return to full duty no restrictions. now my dr and the im say light duty only with a list of restrictions so my employer fired me because i couldnt return to work, i called their dr to get a copy of the report that said i can return only to be told that my employer told them not to release it to me is this legal? now doesnt this sound a bit fishy?

This was an IME doctor, hired by the insurance company? Or a treating physician hired by your employer?

In my opinion, it's time for you to consult a worker's compensation lawyer. The consultation won't cost you anything and, if they represent you, their fee will be based upon a percentage of any benefits you ultimately recover.

i have a lawyer and they wont release it to them either now this is the report that says i can return to work when my dr and the ime say light duty with restrictions i have a hearing in a couple weeks ill just bring it to the judges attention . wont you think the judge will have a problem with that?
