I don't mean to sound condescending or cruel, but with law, bio-dad has more rights than step-brother, with certain exceptions.

Bottom line in law is what is in the best interest of the child! That's all I'm saying, and it's for the courts to decide, not you or he.

I understand, and you're right, it's all about the best interest of the child. I have an appointment with a couple of JAG lawyers on Monday (I'm military) they said they were willing to help in anyway possible so i'm relieved. Thanks for all the information.
