    Default Plea bargains and house arrest

    If someone has been on house arrest for about 6 months and has been offered a plea bargain for a gun charge to do 12 months, will that go towards timed served and lessen his plea time of 12 months or is a plea strictly what they give you. Also he has a previous gun charge, manslaughter, had probation for a couple years and along with the current gun charge, they also found weed and extacy.( those charges were over ten years ago) Do you think the judge would not accept the plea or if he went to trial, what would happen... mind you the lawyer said he got this in the bag. Also can the judge use that in deciding whether to accept the plea and if went to trail would his previuos record follow! Jusswannaknow?

    Default Credit for Time Served

    If this is truly house arrest, the offender should normally get credit for time served. If it was instead a bond with very restrictive terms, but falling short of what might properly be deemed "house arrest", a court might decline to consider that to have been a period of custody for which credit may be given.
